The harmonization of investment crowdfunding

Abstract:
The approval of Regulation (EU) 2020/1503 of the European Parliament and of the Council of 7 October 2020 on European crowdfunding service providers for business,
has given rise to a common regime in the European Union regarding investment crowdfunding. However, the important changes have caused the modification of the Spanish law that regulated it, with the result that two different types of crowdfunding service providers are now foreseen, depending on whether the financing fits with
what is stipulated in the Regulation.
The present work, therefore, analyzes the regime applicable to these two types of
crowdfunding service providers in Spain, after a previous analysis of the context and
regulatory evolution that has given rise to it, and ending with some final thoughts on the current regulatory situation.
